Terms and Conditions (T&Cs)
Introduction
These Terms and Conditions (hereinafter referred to as 'T&Cs') govern the terms of use for the platforms EventSpotter and Vendly, operated by Andreas Schöngruber (SoftMation, hereinafter referred to as 'Provider'). By using the platforms, you agree to these terms.
1. Scope
The following T&Cs apply to the use of the platforms EventSpotter and Vendly and all associated services.
2. Conclusion of Contract
A contract is concluded upon registration on the platform or through the use of the offered services.
3. Services
The Provider operates EventSpotter, a platform for discovering and aggregating events across Austria, and Vendly, a SaaS platform for vending machine operators. The exact scope of features is determined by each respective platform.
4. Pricing and Payment Terms
All prices are in Euros inclusive of statutory VAT unless otherwise stated. Subscription fees for Vendly are due monthly in advance.
5. Third-Party Services
Our platform integrates third-party services like Google, GitHub, LinkedIn, and Facebook. These services may be used for login, API-based features, or social media automation. By connecting, you agree to their respective terms and privacy policies.
6. Data Access via Third Parties
We may access your name, email, or profile picture via connected services. These are used for personalization and functionality as described in our privacy policy.
7. User Responsibilities
You are responsible for your actions on the platform, including usage of connected services. You must comply with all applicable laws and third-party terms.
8. Termination
We may suspend or terminate access if these terms are violated, especially in the case of abuse of integrated services.
9. Changes to Services
We may update or remove third-party integrations at any time. Continued use implies agreement to such changes.
10. Liability
The Provider is only liable for damages caused intentionally or through gross negligence. Liability for indirect damages, consequential damages, or lost profits is excluded unless mandatory statutory provisions provide otherwise.
11. Warranty
Defects must be reported immediately in writing. The Provider is entitled to remedy the defect or provide a replacement at their discretion. Further warranty claims are excluded.
12. Final Provisions
If any provision of these T&Cs is invalid or becomes invalid, the validity of the remaining provisions remains unaffected. Austrian law applies. The place of jurisdiction is Linz, Austria.
